Although the contract between Users and the Owner is entered solely by them, if you obtained Simple Fitness through the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.

User Rights and Obligations
- Withdrawal Rights: This applies to European Consumers only. Known as “right of cancellation” in the UK, this right is referenced as “right of withdrawal” in this document.
- Applicable Restrictions: Provisions in these Terms may apply specifically to certain User categories (e.g., Consumers). Any limitations are clearly indicated.
Terms of Use
Unless stated otherwise, the Terms apply broadly to all Simple Fitness users. Additional or specific conditions of use may apply in certain cases.
By using Simple Fitness, Users confirm the following:
- No restrictions on Consumer or Business User status.
- Users are not located in a country under U.S. Government embargo or designated as “terrorist-supporting.”
- Users are not on any U.S. Government prohibited or restricted party lists.
Content Rights
Unless otherwise noted, all content on Simple Fitness belongs to the Owner or its licensors. The Owner takes all reasonable efforts to ensure compliance with applicable laws. If Users encounter any issues, they are encouraged to contact the Owner directly.
Ownership and Permissions
All intellectual property rights are reserved by the Owner. Users may not use the content for purposes beyond the intended use of the Service. In some cases, personal and non-commercial downloading and sharing may be allowed with appropriate attribution.
User-Provided Content
Users may upload and share content on Simple Fitness, confirming they have the legal right to do so. By providing content, Users grant the Owner a non-exclusive, royalty-free license to use it as necessary for Service operation.
External Resources
Simple Fitness may link to third-party resources, which are outside of the Owner’s control. The Owner is not responsible for the content or availability of these resources.
Acceptable Use
Users are solely responsible for ensuring that their use of Simple Fitness complies with applicable laws. The Owner reserves the right to deny access, terminate contracts, and report misconduct.
Terms and Conditions of Sale
Certain Products offered through Simple Fitness may require payment. Fees, conditions, and availability are specified within the relevant sections of Simple Fitness. Subscription-based Products may be canceled at the end of the billing cycle.
Refunds
For purchases made via the Apple App Store, refunds are processed per Apple’s policies. For direct purchases through Simple Fitness, contact the Owner.
Account Suspension and Deletion
Accounts may be suspended or deleted in cases of material breaches of these Terms.
Intellectual Property
All intellectual property rights are protected under applicable law.
Limitation of Liability
To the maximum extent allowed by law, the Owner is not responsible for indirect, incidental, or consequential damages arising from the use of Simple Fitness.
